WHAT IS THE REGISTER OF ACCREDITED ENTITIES (REA)?

It consists of an official public registry where all companies wishing to participate in the subcontracting process within the construction sector are required to enroll.

This registration aims to certify compliance with the company’s quality and solvency requirements:

  • Infrastructure and Resources: To have at your disposal the appropriate infrastructure and means to carry out the activity, and to directly manage the works while assuming the risks, obligations, and responsibilities inherent to business activity.
  • Training Certification: To certify that the contracted personnel have the necessary training regarding the prevention of occupational risks (Health & Safety).
  • Preventive Organization: To certify that the company maintains an adequate preventive organization.
Register of accredited entities
In which Register of Accredited Entities must the company request registration? What is the validity of the registration?

Registration must be requested at the Register of Accredited Entities (REA) under the jurisdiction of the competent labor authority of the territory where the registered office of the contractor or subcontractor is located. This registration shall be valid throughout the entire national territory.

In addition to registration, what other obligations do companies have regarding the REA?

Once registered, companies must:
Communicate any changes to the company's identification data.
Renew the registration every three years.
Request the cancellation of the REA registration when applicable.

Does a company that performs construction activities have to register in the REA, even if it belongs to a different productive sector?

Yes. Law 32/2006, of October 18, regulating Subcontracting in the Construction Sector (LSC), is applicable to all contracts entered into under a subcontracting regime by companies—whether or not they belong to the construction sector—if they carry out any construction activities. This applies regardless of the productive sector they are categorized in, their CNAE (National Classification of Economic Activities) code, or whether the construction collective bargaining agreement applies to them.

Which self-employed workers are exempt from registration?

Self-employed workers without employees are exempt from this obligation because they are not considered employers in a labor law context. Therefore, any self-employed person who does not have any staff hired under an employment contract is not required to register in the REA (this includes family-member self-employed workers and dependent self-employed workers-TRADE).
Conversely, self-employed workers who have employees under their charge must be registered in the REA.

Do companies not established in Spain that relocate with their workers have to register in the Register of Accredited Entities (REA)?

Exemption for short-term stays: Registration shall not be required for postings with a duration of less than 8 days.

Initial notification as application: The first notification of posting required by Article 5 of Law 45/1999, of November 29, shall constitute the application for registration. This must be accompanied by the declaration of compliance with solvency and business quality requirements (Model Annex I.A of Royal Decree 1109/2007). From the moment of notification, companies will be considered provisionally registered until the labor authority formally grants or denies registration in its Registry.
Subsequent notifications: In all subsequent notifications of posting, the REA registration number must be clearly stated.
