  • Check in person the physical condition of the property.
  • Verify through documentation the legal status of the property (liens, encumbrances, being up to date with community fee payments via a certificate issued by the Community of Owners, among others).

Developers and/or professional sellers of housing are legally obliged to provide a series of data to buyers, being bound by their enforceability, even if they do not expressly appear in the contract.

Among others, developers and/or sellers must have a series of data and documents available to the public: site plans of the dwelling; insurance for damages and hidden defects provided for in the new Building Act; copies of the necessary licenses for the construction and occupation of the dwellings; the Community Statutes; a Certificate issued by the Community of Owners confirming that the seller is up to date with community payments; among others.

For a foreigner outside of Spain to acquire a property in Spain, it is required to have a Foreigner Identification Number (NIE), which is a unique and exclusive number, just as the National Identity Document (DNI) is for Spaniards.

In the first instance, it will be necessary to pass the favorable qualification of the Registrar in their assessment of the document’s legality. The payment of the Property Transfer Tax (Impuesto de Transmisiones Patrimoniales), which levies the sale, must be made. In addition, you will also be obliged to settle the Stamp Duty (Impuesto de Actos Jurídicos Documentados).
